Terms of Service

1. Acceptance of Terms

By accessing or using FeedbackWall (the “Service”), including our web application, SDK, APIs, and all related services, you agree to be bound by these Terms of Service (the “Terms”). If you do not accept these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you (the “User”, “you”, “your”) and MediaVikings, the company operating FeedbackWall (“we”, “us”, “our”).

2. Description of Service

FeedbackWall provides a platform for collecting user feedback in mobile applications through surveys and questionnaires. The Service includes:

  • A web-based dashboard for creating and managing surveys
  • A Swift SDK for integration into iOS applications
  • APIs for data exchange between your application and our servers
  • Analytical tools for viewing collected responses

3. Disclaimer and Limitation of Liability

IMPORTANT NOTICE: Please read this section carefully. By using FeedbackWall, you fully accept the following disclaimers.

3.1 Service Provided “As Is”

FeedbackWall is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, either express or implied. We expressly disclaim all warranties, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties of accuracy, reliability, or completeness of data
  • Warranties that defects will be corrected

3.2 Use at Your Own Risk

You use FeedbackWall, including our SDK, APIs, and web application, entirely at your own risk. This includes, but is not limited to:

  • Integration of the FeedbackWall SDK into your application
  • All decisions made based on data collected through the Service
  • Consequences of surveys displayed to your users
  • Loss of data or business related to use of the Service

3.3 No Liability for Damage to Your Application

FeedbackWall is under no circumstances liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • App Crashes: If integration of our SDK causes your application to crash, freeze, or behave unexpectedly
  • Functionality Issues: If our SDK or APIs negatively affect your app's functionality
  • Performance Degradation: If the Service causes slower load times, increased battery consumption, or other performance issues
  • Data Corruption: Loss or corruption of data in your application related to our integration
  • App Store Rejections: If integration of FeedbackWall leads to rejection from the Apple App Store or other distribution platforms
  • User Complaints: Dissatisfaction from your users regarding surveys or their presentation
  • Loss of Revenue: Lost business, revenue, or profit resulting from use of the Service
  • Reputation Damage: Damage to your brand or reputation as a result of the Service's behavior

3.4 SDK and Technical Risks

By integrating the FeedbackWall SDK into your application, you acknowledge and accept the following risks:

  • The SDK may contain bugs or errors that can affect your app
  • Updates to the SDK may introduce unforeseen compatibility issues
  • Interaction between the SDK and other third-party libraries may cause conflicts
  • Network issues may affect SDK functionality and your app's behavior
  • The SDK may behave differently across different iOS versions and devices

3.5 No Uptime Guarantee

We do not guarantee any specific uptime or availability of the Service. Servers may be unavailable due to:

  • Scheduled or unscheduled maintenance
  • Technical failures or outages
  • Cyber attacks or security incidents
  • Third-party infrastructure issues
  • Force majeure events

3.6 Limitation of Liability

To the maximum extent permitted by applicable law, FeedbackWall's total liability to you for all claims related to the Service is limited to the amount you have paid to us in the preceding 12 months, or USD $50, whichever is less.

4. Your Responsibilities

By using FeedbackWall, you assume the following responsibilities:

  • Thoroughly testing all integrations in a staging environment before production use
  • Having appropriate backup and recovery procedures in place
  • Monitoring your application after integration for any issues
  • Informing your users about data collection in accordance with applicable laws
  • Ensuring your use of the Service complies with all relevant laws and regulations
  • Keeping your API keys and credentials secure

5. Indemnification

You agree to indemnify, defend, and hold FeedbackWall, its directors, employees, agents, and affiliated companies harmless from all claims, losses, damages, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Content you create or distribute via the Service

6. Changes to the Service

We reserve the right at any time and without notice to:

  • Modify, suspend, or terminate the Service or parts thereof
  • Change prices and payment terms
  • Update SDK, APIs, and other technical components
  • Introduce new features or remove existing ones

7. Payment Processing

All payments for FeedbackWall are processed by Paddle (paddle.com), our authorized reseller and Merchant of Record. This means that when you purchase a subscription, you are purchasing from Paddle, and Paddle handles all payment processing, invoicing, sales tax, and refunds.

By making a purchase, you agree to both these Terms of Service (which govern your use of the FeedbackWall product) and Paddle's Buyer Terms (which govern the payment transaction).

Paddle will appear on your credit card or bank statement as the merchant for any charges related to FeedbackWall.

8. Refund Policy

We offer a 14-day money-back guarantee on all purchases. If you are not satisfied with FeedbackWall for any reason, you may cancel your subscription and request a full refund within 14 days of your initial purchase date.

8.1 How to Request a Refund

To request a refund within the 14-day period, please contact us at jgh@mediavikings.dk with your account details and reason for the refund request. Refunds will be processed within 5-10 business days and credited to your original payment method.

8.2 Refund Conditions

By subscribing to or purchasing any paid features of FeedbackWall, you acknowledge and agree that:

  • Refund requests must be submitted within 14 days of the original purchase date
  • After the 14-day period, all payments are final and non-refundable
  • Refunds apply to the most recent billing cycle only; previous payments are not eligible for refund
  • Refunds will not be issued if your account is terminated due to violation of these Terms
  • You are responsible for canceling your subscription before the renewal date if you no longer wish to use the Service

8.3 Subscription Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. No partial refunds are provided for unused portions of a subscription period after the 14-day refund window has passed.

9. Intellectual Property

All content, functionality, and technology on FeedbackWall is our or our licensors' property and is protected by copyright, trademark, and other intellectual property rights.

You retain all rights to the data you collect via the Service. We do not claim ownership of your surveys or the responses you receive.

10. Termination

We may terminate or suspend your access to the Service at any time without prior notice or liability, for any reason, including but not limited to, if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. You are responsible for removing the SDK from your applications.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Denmark. Any dispute arising in connection with these Terms or your use of the Service shall be resolved by the Danish courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes take effect when the updated Terms are published on this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
